Morosidade na adoção faz crianças perderem o futuro

A alteração dada pelo art 39, § 4º da Lei de Adoção ao Estatuto da Criança e do Adolescente mostra a dificuldade dos brasileiros em tutelarem a infância, principalmente a dos mais desamparados. Aprisionadas nas teias da burocracia, que venera a fila de adoção em detrimento dos próprios adotandos, as crianças são jogadas de uma casa de passagem para outra, até se tornam grandes demais para corresponder às expectativas, justamente daqueles que integram a própria fila no cadastro nacional de adoções.
As tentativas de adoção Intuito personae, aquelas em que a mãe genética destina o nascituro a um casal em que confia, quer por relação de parentesco estendido, quer por pura amizade, não têm encontrado guarida no judiciário brasileiro. As mães genéticas, ao decidirem dar os filhos em adoção, são totalmente desconsideradas e passam a ser tratadas como coisas pelo judiciário, sendo-lhe negado o direito de interferirem no destino dos filhos. Faltam vagas nos Centros Intensivos neonatais dos hospitais públicos também porque as crianças abandonadas são ali mantidas até que apareça uma vaga nas casas de acolhimento.
Simultaneamente, casais aptos a adoção e devidamente inscritos na fila nacional, que concordam em receber uma criança com guarda provisória, amargam meses e meses de espera.
Um nenê, cujo poder parental já foi destituído da genitora em três casos anteriores, ocupava um leito da CTI de um grande hospital na semana passada. Não havia vaga para que a criança fosse recolhida. Não há esperança que uma família possa recebê-lo antes de destituído o poder parental. Passarão, no mínimo, dois anos. Passarão todas as oportunidades para que essa criança encontre um lar. Passamos da civilização ao pior sistema de barbárie institucional: aquele que rouba o futuro.
